Terms of Service

These Terms of Service ("Terms") govern your use of the TMC Connect mobile app and timacadeelectronic.com (together, the "Services"), operated by Timacade Electronics ("TMC," "we," "us," or "our"). By using the Services, you agree to these Terms.

1. Using Our Services

You must be able to form a legally binding contract to use the Services. You agree to provide accurate information when creating an account and to keep your login details secure.

2. Products and Pricing

• We make reasonable efforts to display accurate product descriptions, images, and prices, but errors may occasionally occur. If we discover a pricing or listing error after you've placed an order, we will contact you before charging or fulfilling the order.
• Product availability is subject to stock on hand and may change without notice.
• Prices are listed in USD and are subject to change.

3. Orders and Payment

• Orders are confirmed once payment is successfully processed through your selected payment method: EVC Plus (Hormuud), eDahab (Somtel), or Premier Wallet (Premier Bank).
• You are responsible for ensuring you have sufficient funds and that your payment details are correct.
• We reserve the right to cancel or refuse any order, including for suspected fraud, pricing errors, or stock unavailability — in which case any payment already made will be refunded through the original payment method.

4. Shipping and Delivery

• Delivery timeframes and areas served are shown at checkout and may vary by location.
• Risk of loss for products passes to you upon delivery to the address you provided.

5. Returns and Refunds

Eligibility. Customers may request a return for eligible products within 7 calendar days of receiving their order. To qualify, the product must:

• Be unused and in the same condition as received
• Be returned in its original packaging with all accessories, manuals, and included items
• Be accompanied by proof of purchase (such as an order confirmation or receipt)
• Show no signs of misuse, accidental damage, or unauthorized modification

Non-returnable items. The following are not eligible for return or refund unless defective or incorrect upon delivery:

• Products damaged due to customer misuse or improper handling
• Products with missing accessories, packaging, or documentation
• Products that have been modified or repaired by unauthorized persons
• Clearance, final-sale, or specially ordered items (unless required by applicable law)

Defective or incorrect products. If you receive a defective, damaged, or incorrect product, contact us within 48 hours of delivery. After verification, we will provide a replacement, repair, or refund, depending on the circumstances and product availability.

Return shipping.

• If the return is due to a defective, damaged, or incorrect product, TMC will cover the reasonable return shipping costs.
• If the return is for any other eligible reason (such as changing your mind), you are responsible for the return shipping costs.

Refund process. Once the returned product has been received and inspected, we will notify you of the outcome of your refund request. If approved, your refund will be processed using the original payment method whenever possible; processing times may vary depending on your payment provider or financial institution. Original shipping charges, customs duties, taxes, or other service fees (if applicable) are generally non-refundable unless the return is the result of our error or a defective product.

6. Account Responsibilities

You are responsible for all activity under your account. Notify us immediately at support@timacadeelectronic.com if you suspect unauthorized use of your account.

7. Prohibited Uses

You agree not to:

• Use the Services for any unlawful purpose
• Attempt to interfere with or disrupt the Services
• Provide false information when placing an order
• Resell products purchased through the Services without our written consent, unless you are an authorized reseller

8. Intellectual Property

All content on the Services — including the TMC name, logo, product descriptions, and app design — is owned by Timacade Electronics or its licensors and may not be used without permission.

9. Limitation of Liability

To the fullest extent permitted by law, TMC is not liable for indirect, incidental, or consequential damages arising from your use of the Services. Our total liability for any claim related to an order will not exceed the amount you paid for that order.

10. Disclaimer of Warranties

The Services are provided "as is." We do not guarantee the Services will be uninterrupted or error-free. Products sold through the Services carry the manufacturer's warranty, if any, rather than a separate warranty from TMC unless otherwise stated on the product listing.

11. Termination

We may suspend or terminate your access to the Services if you violate these Terms.

12. Governing Law

These Terms, including the Return and Refund Policy above, are governed by and interpreted in accordance with the laws of the Federal Republic of Somalia.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
